Rental Terms & Conditions

Effective Date: October 1st, 2025
Company: USA Tool Rentals LLC (“Company,” “We,” “Our,” or “Us”)
Customer: The individual or entity renting equipment (“Customer,” “You,” or “Your”)

By renting any equipment from USA Tool Rentals, the Customer agrees to the following Terms and Conditions, which govern all rentals, reservations, and use of equipment.

1. Rental Agreement and Acceptance

1.1. This Agreement is a legally binding contract between the Customer and USA Tool Rentals.
1.2. Customer agrees to these terms upon signing the rental contract, paying the invoice, or taking possession of equipment.
1.3. USA Tool Rentals reserves the right to refuse service or terminate a rental at its discretion.

2. Equipment Ownership and Condition

2.1. All equipment remains the sole property of USA Tool Rentals.
2.2. Equipment is rented in good working order and must be returned in the same condition, normal wear and tear excepted.
2.3. Customer acknowledges inspecting the equipment before rental and agrees it is in satisfactory condition and fit for use.

3. Rental Period and Charges

3.1. Rental charges begin when the equipment leaves the rental yard and continue until it is returned and checked in by USA Tool Rentals.
3.2. Rental periods include daily, weekend, and weekly rates as listed in the contract.
3.3. Returning equipment late may result in additional charges based on the applicable rate schedule.
3.4. No refunds are provided for early returns once equipment has left the premises.

4. Payment and Deposits

4.1. A valid government-issued ID and payment method are required at the time of rental.
4.2. Security deposits may be required and will be refunded upon return of equipment in acceptable condition.
4.3. Customer authorizes USA Tool Rentals to charge all rental fees, taxes, fuel, cleaning, and damage costs to the payment method on file.

5. Customer Responsibilities

Customer agrees to:

  • Operate the equipment safely, for its intended purpose, and in accordance with manufacturer instructions.

  • Use the equipment only at the specified job site and not for any illegal or hazardous activity.

  • Protect the equipment from theft, misuse, damage, or exposure to severe weather.

  • Perform basic maintenance such as checking fluids, tire pressure, or battery charge (as applicable).

  • Notify USA Tool Rentals immediately if the equipment becomes unsafe, damaged, or inoperable.

6. Damage, Loss, and Theft

6.1. Customer is responsible for all loss or damage to equipment during the rental period, regardless of cause.
6.2. In the event of theft, Customer must:

  • File a police report within 24 hours, and

  • Provide a copy to USA Tool Rentals.
    6.3. The replacement cost will be determined by current market value or manufacturer list price, whichever is higher.
    6.4. Cleaning fees may apply if equipment is returned excessively dirty or contaminated with materials such as concrete, paint, or oil.

7. Indemnification and Liability

7.1. Customer assumes all risk associated with possession, use, transportation, and storage of the equipment.
7.2. Customer agrees to indemnify, defend, and hold harmless USA Tool Rentals, its employees, and affiliates from any claims, losses, injuries, or damages arising out of equipment use.
7.3. USA Tool Rentals shall not be liable for incidental, consequential, or special damages, including delays, lost profits, or business interruption.

8. Equipment Malfunction

8.1. If equipment malfunctions, Customer must immediately cease use and contact USA Tool Rentals.
8.2. USA Tool Rentals will, at its discretion, repair or replace the equipment.
8.3. No credit or adjustment will be made for downtime caused by misuse, neglect, or failure to follow instructions.

9. Transportation and Delivery

9.1. Delivery and pickup services are available for an additional fee.
9.2. Delivery includes curbside or driveway drop-off only unless otherwise agreed.
9.3. Customer assumes responsibility for securing and unloading the equipment upon delivery.
9.4. Delivery charges are non-refundable once dispatched.

10. Fuel, Consumables, and Batteries

10.1. Gasoline, diesel, propane, and other consumables are Customer’s responsibility unless otherwise stated.
10.2. Equipment must be returned with fuel levels equal to those at the time of pickup. Refueling fees may apply.
10.3. Battery-powered tools must be returned with chargers and all accessories.

11. Cancellation and Reservation Policy

11.1. Reservations can be canceled up to 24 hours in advance without penalty.
11.2. Cancellations within 24 hours or failure to pick up reserved equipment may result in a cancellation fee equal to one day’s rental rate.
11.3. Weather-related cancellations are reviewed case by case.

12. Insurance and Risk of Loss

12.1. Customer is responsible for maintaining property and liability insurance covering rented equipment.
12.2. USA Tool Rentals may offer optional damage waivers; these do not cover loss due to theft, neglect, or misuse.
12.3. Risk of loss passes to the Customer upon pickup or delivery and remains until return and inspection.

13. Governing Law and Dispute Resolution

13.1. This Agreement shall be governed by and construed under the laws of the State of Texas.
13.2. Any disputes shall be resolved through binding arbitration in Harris County, Texas.
13.3. Both parties waive any right to trial by jury.

14. Default and Remedies

14.1. Failure to pay fees, return equipment, or comply with these terms constitutes a default.
14.2. In the event of default, USA Tool Rentals may:

  • Terminate the rental,

  • Retrieve equipment without notice, and

  • Charge all unpaid amounts, including legal fees and recovery costs.

15. Entire Agreement

 

15.1. This document represents the entire agreement between the Customer and USA Tool Rentals.
15.2. No oral modifications are binding unless in writing and signed by both parties.
